A CHARTER ORDINANCE EXEMPTING THE CITY OF ANDOVER, KANSAS FROM CERTAIN PROVISIONS WITHIN K.S.A.12-189 DEALING WITH THE RATE OF SALES TAX WITHIN THE CITY OF ANDOVER, KANSAS.
WHEREAS, the provisions of K.S.A. 12-188 et seq. are not uniformly applicable to all cities; and
WHEREAS, Article 12 Section 5 of the Kansas Constitution empowers a city to exempt itself from the application of non-uniform state statutes;
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANDOVER, KANSAS, AS FOLLOWS:
Section 1: The provisions of K.S.A. 12-189 fixing the amount of sales tax within Class A, Class B, and Class C cities at .25%, .5%, .75%, or 1 % are hereby declared inapplicable to the City of Andover, Kansas.
Section 2: In lieu of the foregoing provisions contained within K.S.A. 12-189, the City of Andover may adopt a sales tax, fixing its rate in any amount determined appropriate by the governing body.
