A CHARTER ORDINANCE EXEMPTING THE CITY OF ANDOVER, KANSAS FROM THE PROVISIONS OF K.S.A. 12-631k(b), 12-860(b), 14-569(b), RELATING TO THE ASSESSMENT OF DELINQUENT SEWER CHARGES AGAINST REAL ESTATE.

WHEREAS, the State of Kansas, through Senate Bill No. 328 amended the provisions of K.S.A. 12-631k, 12-860, and 14-569; and

WHEREAS, the amendments to the above referenced statutes are not uniformly applicable to all cities; and

WHEREAS, the Governing Body believes it to be in the best interests of Andover, Kansas to exempt the City from the statutory changes.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANDOVER, KANSAS, AS FOLLOWS:

Section 1: The City of Andover, Kansas, by the power invested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to and exempts itself from and makes inapplicable to it, K.S.A. 12-631k(b), K.S.A. 12-860(b), and K.S.A. 14-569(b), in all other respects, the above referenced statutes will remain fully applicable to the City of Andover.
