A CHARTER ORDINANCE EXEMPTING THE CITY OF ANDOVER, KANSAS FROM K.S.A. 12-205 AND PROVIDING SUBSTITUTE PROVISIONS ON THE SAME SUBJECT RELATING TO THE REMOVAL OF CITY OFFICERS.
BE IT ORDAINED by the Governing Body of the City of Andover, Kansas:
SECTION 1: That the City of Andover, Kansas, by the power vested in it by Article 12, Section 5, of the Constitution of the State of Kansas, hereby elects to make inapplicable to it and exempts itself from K.S.A. 12-205 as it relates to the removal of City Officers, which statute applies to the City of Andover but is not uniformly applicable to all cities. The City further provides substitute provisions on the same subject as hereinafter provided.
SECTION 2: Any officer may be removed from his/her office, with or without cause, by a majority vote of the entirety of the Governing Body. Any officer may be suspended from his/her office with pay by the mayor.
SECTION 3: This Ordinance shall be published once each week for two consecutive weeks in the official city newspaper and shall take effect 60 days after its final publication unless within 60 days of its final publication a Petition signed by a number of electors of the City equal to not less than 10% of the number of electors who voted at the last preceding regular City election shall be filed in the office of the City Clerk of the City demanding that such Ordinance be submitted to a vote of the electors. In such event this Ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon. Upon this Ordinance taking effect it shall be designated at Section 1-201.1 of the Code of the City of Andover, Kansas.
