A CHARTER ORDINANCE REESTABLISHING THE FORM OF GOVERNMENT AND THE NUMBER OF CITY COUNCIL POSITIONS WITHIN THE CITY OF ANDOVER, KANSAS.
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ANDOVER, KANSAS, AS FOLLOWS:
SECTION 1: From and
after the effective date of this Ordinance the Governing Body of the City of
Andover, Kansas, shall consist of a Mayor and six (6) Council Members, all of
whom shall be elected by the City at Large. No person shall be eligible for the
office of Mayor or Council Member who is not at the time of election an actual
resident of the City of Andover, Kansas.
SECTION 2. The Mayor
and each member of the City Council shall serve for a term of four (4) years
with three (3) Council members to be elected during the regular City Election
to be held on the first Tuesday in April of 2001 and the Mayor and three (3)
Council members to be elected thereafter at the Regular City Election to be
held on the first Tuesday in April of 2003. The vacancy necessarily created
upon the effective date of this Ordinance, as well as any vacancy occurring
thereafter, shall be filled by appointment made by the Mayor but only upon the
approval of such appointment by the Governing Body.
SECTION 3. The city
of Andover, Kansas, by virtue of the power vested in it by Article 12, §5 of
the Constitution of the State of Kansas, hereby elects to make inapplicable to
it and exempts itself from those provisions within K.S.A. 14-101, et seq., and
K.S.A. 14-201, et seq., the extent that the provisions contained therein are
inconsistent with the foregoing. Additionally, prior Charter Ordinance No. 11
shall be repealed upon the effective date of this Ordinance to the extent that
the provisions contained therein are inconsistent with the foregoing. In
exempting itself, the City finds that the statutory provisions referenced above
are applicable to cities of the second class, but not uniformly applicable to
all cities and the City hereby adopts substitute and/or additional provisions
on the same subject as provided for herein.
