Commencing April 1, 2017, the transient guest tax is hereby increased to eight percent (8%) of the gross rental receipts derived from or paid by transient guests for sleeping accommodations, exclusive of charges for incidental services or facilities, in any hotel, motel or tourist court within the City.

That the taxes levied by this ordinance shall be paid by the consumer or user to the business and it shall be the duty of each and every business to collect from the consumer or user the full amount equal as nearly as possible or practicable to the average equivalent thereof.  Each business collecting any of the taxes levied hereunder shall be responsible for paying over the same to the Kansas Department of Revenue on or before the last day of each month immediately succeeding the month in which it is collected, with the first payment due on or before the last day of November, 1990, except as the secretary of revenue may otherwise prescribe.  Each business shall make a true report to the department of revenue, on a form prescribed by the secretary of revenue, providing such information as may be necessary to determine the amounts to which any such tax shall apply for all gross rental receipts for the applicable month or months, which report shall be accompanied by the tax disclosed thereby; and each such business shall comply with such other requirements which the secretary of revenue may prescribe concerning the collection, reporting and payment of such tax.

That all moneys received by the city treasurer from disbursements from the state treasurer of Transient Guest Tax revenues shall be credited to the tourism and convention promotion fund of the City, which fund is hereby created upon first receipt by the city treasurer of such tax revenues, and shall only be expended by the City for convention and tourism promotion.

That there is hereby established a Convention and Tourism Committee to make recommendations concerning the programs and expenditures for promotion of conventions and tourism within the City. The Governing Body shall appoint a minimum of five (5) members to such committee, which members shall be involved with or interested in the promotion of conventions or tourism within the City.  Each committee member shall be appointed for a term of not to exceed four (4) years. The Governing Body shall have the authority to contract for convention and tourism programs to be implemented.

That any entity to which funds, which in the aggregate in any year exceed $25,000.00, are provided for convention and tourism promotion purposes from moneys received pursuant to this ordinance shall provide to the Governing Body an accounting of the expenditures of such funds in accordance with generally accepted accounting principles.
